1. Introduction

  • Welcome to Life’s Echo, a company specialising in providing an AI powered service creating AI representations of individuals life’s experiences and personal information with their permission, by recording their voice and collecting detailed information about their life. With the AI character accessed by designated individuals during and after the end user’s death.

These Terms and Conditions govern your use of Life’s Echo’s services, including our AI platform, website, and any related services (collectively referred to as “Services”). By accessing or using our Services, you agree to comply with these Terms and Conditions and our Privacy Policy. If you do not agree to these Terms, you should not use our Services.

2. Definitions

  • “Life’s Echo,” “We,” “Our,” “Us”: Refers to Life’s Echo Ltd, a company registered in the United Kingdom.

  • “You,” “Your,” “User”: Refers to any person or entity using our Services.

  • “Services”: Refers to all products and services provided by Life’s Echo, including the AI cloning platform, website, software applications, and customer support.

“Content”: Includes all text, graphics, images, software, audio, video, and other materials available through our Services.

3. Eligibility

By using our Services, you confirm that you are at least 16 years old. If you are under 16, you must have the consent of a parent or guardian to use our Services. We do not knowingly collect personal data from children under 16 without such consent. If we become aware of any unauthorised data collection, we will promptly delete the data.

4. Changes to Terms and Conditions

Life’s Echo reserves the right to update or modify these Terms and Conditions at any time. We will notify you of significant changes by posting the new Terms on our website and updating the effective date. Your continued use of the Services after such changes constitutes acceptance of the new Terms.

5. Use of Services

5.1. Permitted Use

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

  • In any way that violates any applicable local, national, or international law or regulation.

  • To engage in any unlawful or fraudulent activity.

  • To send, knowingly receive, upload, download, use, or re-use any material that does not comply with our Content Standards (see Clause 8).

  • To transmit or procure the sending of any unsolicited or unauthorised advertising or promotional material, such as spam.

  • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, or any other harmful programs designed to adversely affect the operation of any computer software or hardware.

5.2. Account Registration

To access certain features of our Services, you will be required to create an account. You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

6. Intellectual Property Rights

6.1. Ownership of Content

All intellectual property rights in our Services, including but not limited to trademarks, service marks, logos, text, graphics, software, audio, video, and other content, are owned by or licensed to Life’s Echo. You may not use, reproduce, distribute, or create derivative works from any of our content without our prior written consent.

6.2. User-Generated Content

6.2.1 By submitting, posting, or displaying content through our Services, you grant Life’s Echo a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the Services.

You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to grant such a license.

Content marked “Private”. This content can only be accessed by the nominated people designated by the user and their Administrative Executors. Any disputes about access will be dealt with by the user or their Administrative Executor if they are incapacitated or die. Life’s Echo will only take instruction from these parties and will not engage in correspondence with anybody other than these designated people about any aspects of Life’s Echo.

 

6.2.2  Ownership of User Generated Content during life.

This is owned by the user who always created it, and at any time, the user can ask Life’s Echo to pass them a copy and delete the Life Echo from its systems.

6.2.3 Ownership of User Generated Content after death.

The user, Administrative Executors, have full legal control over access to Life’s Echo, and can at any time ask Life’s Echo to pass them a copy and delete the Life Echo from its systems.

6.2.4  Content marked as Public.

If a user designates their content as public, it will be published openly on the site and fully accessible via the internet. Although Life’s Echo will delete this content from its servers if requested, it can take no responsibility if anybody has copied and continues to use this content after it was published with the user’s permission.

7. Privacy and Data Protection

Our use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference. By using our Services, you consent to our collection, use, and sharing of your personal data as described in our Privacy Policy.

8. Content Standards

8.1 These content standards apply to all material that you contribute to our Services (“Contributions”), and to any interactive services associated with it. You must comply with the spirit and the letter of the following standards. Contributions must:

  • Be accurate (where they state facts).

  • Be genuinely held (where they state opinions).

  • Comply with applicable law in the UK and in any country from which they are posted.

Contributions must not:

  • Contain any material that is defamatory, obscene, offensive, hateful, or inflammatory.

  • Promote sexually explicit material or violence.

  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

  • Infringe any copyright, database right, or trademark of any other person.

  • Be likely to deceive any person.

  • Promote any illegal activity.

  • Be threatening, abusive, or invade another’s privacy, or cause annoyance, inconvenience, or needless anxiety.

  • Be likely to harass, upset, embarrass, alarm, or annoy any other person.

9. Appoint Administrative Executors

9.1 You must designate one or two administrators (“Administration Executors”) who will have access to and control over your services, during and after your death.

9.2 You are responsible for informing your assigned Administrative Executors of their role and providing them with necessary access information.

 

10. Third-Party Services

Our Services may contain links to third-party websites or services that are not owned or controlled by Life’s Echo. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Life’s Echo shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of any such third-party services.

11. Limitation of Liability

To the maximum extent permitted by law, Life’s Echo shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use our Services.

  • Any unauthorised access to or use of our servers and/or any personal information stored therein.

  • Any interruption or cessation of transmission to or from our Services.

  • Any bugs, viruses, or harmful programs transmitted through our Services.

  • Any errors or omissions in any content or for any loss or damage incurred because of your use of any content posted, emailed, transmitted, or otherwise made available through the Services.

  • Any emotional distress or psychological impact experienced by users or their designated contacts when interacting with the user’s contributions

  • We do not guarantee that the services will perfectly replicate your voice, personality or memories.

  • Any misuse of the service by Assigned Executors or other individuals who gain access to your AI character.

Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury caused by our negligence.

  • Fraud or fraudulent misrepresentation.

  • Any matter for which it would be unlawful for us to exclude or attempt to exclude our liability.

12. Indemnity

You agree to indemnify, defend, and hold harmless Life’s Echo, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms, your use of the Services, or your violation of any law or the rights of a third party.

13. Disclaimer

Life’s Echo service is not a substitute for professional grief counseling or therapy. We strongly recommend that grieving individuals seek appropriate professional support. By using Life’s Echo, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.

14. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be deemed to be deleted, and the validity and enforceability of the remaining provisions shall not be affected.

16. Waiver

No failure or delay by Life’s Echo in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or privilege preclude any other or further exercise thereof.

17. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Life’s Echo regarding your use of our Services and supersede all prior agreements or understandings, whether written or oral, relating to such subject matter.

18. Termination or Suspension

18.1 Life’s Echo reserves the right to terminate or suspend your access to our Services, without notice, for conduct that we believe violates these Terms and Conditions or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

18.2 You may request the deletion of our services and all associated data at any time during your lifetime.

 

18.3 After your death, your Assigned Executors will have the authority to maintain or terminate the service.

 

18.4 We reserve the right to modify or discontinue the service at any time, with notice to users and Assigned Executors.

19. Feedback and Complaints

If you wish to provide feedback or make a complaint about our Services, please contact us at support@lifesecho.co.uk We aim to respond to all complaints within 14 days.
